AGREEMENT BETWEEN THE USER AND BHT.AZ
"www.bht.az" Trademark, BAKU HOLIDAY LLC publishes this Agreement, which determines the procedure for providing services to users. This Agreement is a public contract-offer (official offer) to any user.
Each user before receiving services on the site must read and approve without any changes all the terms and conditions set forth below in this Agreement.
1. Terms used in this Agreement:
Website - a website located on the Internet at BHT.AZ.
Order - the User's request to receive the services selected on this Site, which is duly executed, namely, it contains reliable information and parameters necessary for the provision of services.
The contractor is “WWW.BHT.AZ” Baku, Azerbaijan, which provides services for providing information from the booking system through the bht.az website.
User - an individual who has reached the age of 18, not limited in legal capacity in the manner prescribed by law, who has the legal right to enter into contractual relations with the Contractor, including placing an order or booking services on the Site.
Service providers - airlines, their official representatives who provide air transportation services to the User, insurance companies, transport companies, companies providing services for booking accommodation.
An electronic passenger ticket is a document used to certify a contract for the carriage of a passenger and baggage, which contains information on the carriage of a passenger and baggage in electronic digital form.
Booking system - an automated system connected to service / resource providers, in which the search, booking and registration of services takes place.
Itinerary receipt - an agreement between the user and the airline for the services provided.
2. General provisions
2.1 bht.az reserves the right to change the terms of this Agreement at its sole discretion without prior notice.
The use of the Site by the user, namely the opening of any page or the use of any service, means his acceptance of the terms of the Agreement, as well as with possible updates and changes that may be made to the Agreement;
2.2 The User enters into this Agreement by putting a mark in the form of a “tick” in the column “I accept the terms of the Agreement with bht.az at the last stage of placing an Order on the Site;
2.3 After placing an order, this Agreement is the main document in the official relationship between the User and bht.az;
2.4 The Parties have agreed that all exchange of information and documents under this Agreement is carried out via e-mail, the address of which was specified by the User during registration and / or booking a ticket;
2.5 When buying a ticket or other services on the bht.az website, the user independently and directly enters into contractual relations with service providers on the terms presented to the user on the website;
2.6 The Contractor provides the user with the services of selecting the optimal flight route, the carriage fee for transportation in accordance with the priority parameters of the conditions of transportation specified by the passenger, booking, issuing and issuing tickets, as well as providing information and consulting support to the user after purchasing a ticket.
2.7 The Contractor's obligation is considered to be fulfilled properly and in full from the moment the user is sent to the e-mail address specified during booking, the itinerary receipt containing the terms of the concluded air transportation agreement between the user and the service provider.
3.1 By using the bht.az website, you irrevocably agree to comply with the following terms and conditions and confirm that:
3.1.1 You are over 18 years old, you are capable, legally capable, have the legal right to enter into contractual relations with bht.az and will use the site in accordance with this agreement, and you are aware of and assume responsibility for the obligations imposed on you as a result of the conclusion of this Agreement and use of the bht.az website;
3.1.2 When working with the site, you undertake to provide reliable, truthful, up-to-date and complete information about you and / or third parties in whose favor the booking and / or purchase of a ticket or other services is made;
3.1.3 You assume all possible risks and costs associated with possible errors and inaccuracies when placing an order, made by you on purpose or accidentally during the purchase and / or booking and / or rebooking;
3.1.4 You are informed and agree that a change in the personal data of passengers in a placed order is the basis for the invalidation of the tariffs agreed upon in the order. A change in personal data in a placed order is the basis for issuing a new ticket and collecting additional funds according to the airline tariffs for issuing a new ticket and / or changing personal data on the ticket. If it is necessary to make changes to personal data, you undertake to pay for making changes and / or issuing a new ticket, as well as a service fee of 15 manat;
3.1.5 In the case of booking and/or purchasing tickets for third parties, you undertake to inform these persons about all conditions, rules and restrictions of the selected fare, as well as about all possible changes related to the purchase and booking;
3.1.6 You consent to the processing of all personal data specified in the application, including data of third parties in favor of which a booking or ticket purchase is made. You also confirm that personal data of third parties is provided with their consent and third parties have given their consent to the processing of personal data by any means, including electronic copying, reproduction, cross-border transfer of personal data, depersonalization, blocking, destruction;
3.1.7 You are aware that service providers may request additional information and undertake to provide the requested information upon request within the time period specified in the relevant request;
3.1.8 You undertake to regularly, until the moment you use the ticket or other service purchased on the website, independently monitor the status of your order, including checking your email for information about possible changes, and if necessary, contact bht.az through the form feedback on the bht.az website or by contact phone numbers indicated on the website.
3.1.9 You agree to provide an up-to-date emergency phone number and email address. All notifications about changes in the flight schedule, changes in the airport of departure / arrival, flight cancellation or changes in any other flight parameters are carried out in writing by bht.az to the email address specified by the user when placing an order, subject to receipt of notification of these changes by the airlines. Airlines have the right to provide this information directly to the user using the phone number indicated in the booking. The user undertakes to monitor messages in the mailbox, as well as messages to the specified phone number from the moment the order is placed until the end of the trip. Otherwise, bht.az is not responsible for failure to notify the passenger of a change in the flight schedule, change in the airport of departure / arrival, flight cancellation or changes in any other flight parameters if, when booking an air transportation, the passenger refused to provide his contact details or provided incorrect contact details (phone number, e-mail address, etc.), or, bht.az was unable to contact the passenger using the specified contact details, contacting at least once by phone number or e-mail address, etc.), including including as a result of providing incorrect contact details by the passenger. In these cases, the Contractor shall not reimburse the passenger for losses caused by such non-notification. The Contractor is also not responsible for not providing the specified information in cases where this information was not provided by the service provider (Airline);
3.1.10 You agree to assume full responsibility for the preparation of all necessary documents for the trip, guarantee the correctness and completeness of the documents required upon departure and arrival, as well as during transit flights for following all routes, for traveling along the entire route, the availability of the necessary visas, valid passports, powers of attorney or other documents. The Contractor is not responsible for ignorance or non-compliance by the passenger with all the necessary requirements of the country of departure and country of arrival. 4. Procedure for payment for services
4.1 Payment can be made by bank card on the Contractor's website or at the Contractor's office.
4.2 Payment of the cost of the order by credit card
4.2.1 Payment must be made directly by the User - the cardholder;
4.2.2 Bank card transactions are authorized by the payment system through which the payment transaction is carried out. If the payment system has reason to believe that the operation is fraudulent, the system has the right to refuse to carry out this operation;

4.2.2 When the User pays for services, the Contractor undertakes not to store information about the user's bank card.
4.2.3 Payment is made via a secure connection through payment systems. Data transfer is protected by SSL Web Server Certificates with EV from Kapital Bank.
4.3 The cost of the services booked by the User is indicated on the bht.az website at the last stage of the booking in the currency of the service provider in an explicit form and consists of:
4.3.1 Costs of transportation/hotel accommodation, transfers or other travel services;
4.3.2 bht.az fees (if applicable);
4.4 When selling a ticket, we may charge an additional fee for the selection of the optimal route of transportation, the carriage fee for transportation in accordance with the priority parameters of the conditions of transportation specified by the passenger, booking, issuing and issuing tickets, as well as information and consulting support for the user after purchasing the ticket. This fee is non-refundable.
4.5 If, for any reason, the bht.az fee was paid, but the ticket was not issued, we undertake to cancel the payment and return the paid amount to you within 3 (three) days;
4.6 The amount deducted from the User's bank card after the purchase of a ticket may differ from the specified amount of the order if the currency of your bank card and the currency of the service provider do not match. Your bank can make the conversion at its own internal rate. Before making a purchase, we recommend that you check with your bank representative for the internal exchange rate and the availability of a possible conversion fee. By paying for the ticket, you confirm that you agree with the final cost, taking into account the costs associated with the conversion.
4.7 By the fact of payment, the User confirms that he is informed and agrees with the rules for returning, exchanging and canceling tickets, with all the details of his trip, including dates of flight / accommodation / transfer, departure / arrival time, transfer, passenger data, class of service, etc. service characteristics.
4.9 After the User makes payment for the Order, the itinerary receipt and confirmation of payment for the booked services are automatically generated and sent to the email address specified by the User, specified during registration and / or when booking a ticket / hotel / transfer.
5. Liability of the parties
5.1 The information and description of the services published on the website may contain inaccuracies and errors. In particular, the Contractor does not guarantee complete accuracy and is not responsible for the incompleteness or inaccuracy of the information or description of any service provided by the Service Providers.
5.2 The Contractor shall not be liable if the User suffers damage caused by the complete or partial inoperability of the Site or its components.
5.3 The Contractor is not responsible for any inconvenience and possible losses and does not reimburse any indirect or direct costs that may occur as a result of actions or inaction of third parties, including:
5.3.1 If it is impossible to fulfill the obligations assumed, due to the unreliability, insufficiency and untimeliness of the information and documents provided by the User, or violation by the User of the terms of this Agreement or the requirements for documents;
5.3.2 for the actions of carriers (changing, canceling, rescheduling, delaying the departure of flights, trains, buses and other vehicles, changing the cost of tickets, withdrawing the fare from sale, canceling unpaid or paid reservations), for the safety, loss or damage to baggage, cargo , valuables and documents of passengers during the entire period of their trip. In these cases, the responsibility to passengers in accordance with international rules lies with the Service Provider;
5.3.3 for the actions of the customs and immigration authorities;
5.3.4 for the actions of the consulates of foreign states, including for the delay, refusal or change in the timing of the issuance of entry visas;
5.3.5 for the consequences of violation by the passenger of customs and border formalities, rules of travel and baggage, as well as violation of special rules of conduct in the country of temporary stay;
5.3.6 for non-appearance or lateness of passengers for flight check-in;
5.3.7 for non-compliance by passengers with the rules of conduct established by the carrier;
5.3.8 for the authenticity and correctness of the execution of documents (the reliability of the information contained in them).
5.4. The Parties to the Agreement are released from liability for improper performance or non-performance of obligations under this Agreement in the event of force majeure circumstances that made it impossible for the User and the Contractor to properly fulfill their obligations, as well as other circumstances that the parties cannot influence and prevent.
5.5 In the event that the User violates this Agreement, any law or the rights of third parties, the User agrees to indemnify bht.az and the company's employees from any claims, lawsuits and demands brought by third parties, as well as losses, damages, fines and other expenses.
6. Return and cancellation of services
6.1 Refund of air tickets. Exchange, cancellation and return of tickets is made in accordance with the rules of the selected Service Provider. These rules are displayed explicitly when booking a ticket. When exchanging/refunding a ticket, in addition to the possible penalties of the airline under the fare rules, the Contractor has the right to charge an additional fee for making an exchange/refund. The amount of the fee is indicated explicitly after the initiation of the procedure for the return, exchange, cancellation, annulment, is 15 manat.
6.2 Return and cancellation of the transfer service. The transfer can be booked up to 16 hours before the meeting time with the client for the following vehicle classes: (Micro, Economy, Comfort, Minivan 4 passengers, Minibus 7 passengers) with instant confirmation. The transfer can be booked 24 hours before the meeting time with the client for the following vehicle classes: (Premium Minibus 6 people, Minibus 10,13,16,19, Business, Premium) with instant confirmation. Changes to these bookings, respectively, can be accepted more than 16 and 24 hours in advance, respectively, of the transfer classes. Cancellation by class: Micro, Economy, Comfort, Minivan 4 passengers, Minibus 7 passengers can be made without penalties at least 5 hours before the transfer, less than 5 hours -100% penalty. Cancellation by class: Premium Minibus 6 pax, Minibus 10,13,16,19 pax, Business, Premium can be made without penalties at least 24 hours before the transfer, less than 24 hours - 100% penalty.
The waiting time for the transfer at the meeting point is no more than 60 minutes. The waiting time for the transfer in case of a flight delay is no more than 30 minutes. The client must inform the support service about the presence of children, animals, additional baggage no later than 24 hours before the start of the transfer.
6.3 Return and cancellation of accommodation. Produced in accordance with the rules of the tariff for which the accommodation is booked. The fare conditions are indicated on the website at the time of booking.
6.4 When returning, exchanging, or canceling the service, the bht.az fee (if any) paid when purchasing a ticket is non-refundable.
6.5 An application for exchange, cancellation and return of services is made through the bht.az website through the feedback form and by sending an application to e-mail [email protected]
. Refunds are made in the same way that the payment for services was made. Refunds to the card are made from 1 to 30 days, depending on the working conditions of the bank that issued your card.
7.1 Promotional codes may be provided to the User as part of marketing activities, or in other cases at the discretion of the Contractor.
7.2 Promo codes provide discounts on flights or other services when purchased on the bht.az website or in the bht.az mobile applications.

8. Special conditions
8.1 The Contractor and the Service Providers may unilaterally and without notice cancel the reservation or the placed order in the event of a "multiple reservation" (more than one reservation for a particular passenger for the same flight for one or more dates);
8.2 The list of services of the Site does not include the booking and sale of tickets for unaccompanied minors, passengers with disabilities, late pregnant women
8.3 The user is aware and agrees:
8.3.1 with the conditions for the application of carriers' fares, including the conditions for the return, cancellation and exchange of tickets;
8.3.2 with the requirements for passports and other formal documents, including the period of validity of the passport required to obtain a visa and enter the host country;
8.3.3 on the features and rules of border (customs) control (regime) of foreign states;
8.3.4 on the obligation to comply with customs and border regulations;
8.3.5 that passengers are solely responsible for the validity of passports, travel permits for underage children and other documents required for crossing the border, for the accuracy of the information contained in these documents;
8.3.6 that the deportation of a passenger with invalid entry or exit documents is carried out solely at the expense of the passenger. The passenger is obliged to independently obtain the necessary information at the consulate of the respective country;
8.4 The user assumes responsibility for the preparation of all necessary travel documents. The passenger should familiarize himself with and comply with all the requirements of the Country to which he is sent, including the requirements for issuing documents required upon departure and arrival, the need to issue visas or other documents for the departure of children, animals, the need to issue permits for the export of weapons, for the export art treasures and other permits and approvals;
8.5 The Contractor reserves the right to refuse the User to provide services without giving reasons. The Contractor shall immediately notify the User of the adoption of such a decision. The funds are subject to return to the User to the same details from which the payment for the Order was made.
